Launching a Marketplace or Online Platform in Thailand: What to Assess

A digital platform serving users in Thailand can need to notify the Electronic Transactions Development Agency (ETDA) before operating, under the Royal Decree on Digital Platform Services that Require Notification B.E. 2565, once it passes set revenue or user thresholds. The Royal Decree also covers platforms operated from outside Thailand that serve Thai users. Separately, the Personal Data Protection Act B.E. 2562 reaches offshore controllers that offer services to people in Thailand. What applies depends on the model, the money flows and the users.

Four questions a platform launch has to answer

  1. Is the service a platform intermediary, or a shop selling its own goods and services?
  2. Will it pass the revenue or user thresholds, and is it operated from Thailand or abroad?
  3. Who holds customer money, and could a payment or stored-value function bring in Bank of Thailand rules?
  4. What personal data does it collect from people in Thailand, and if the controller is offshore, does it need a representative in Thailand?

If it is a digital platform service within the Royal Decree B.E. 2565 and passes the revenue threshold (THB 1.8 million a year for an individual, THB 50 million for a juristic person) or the user threshold (more than 5,000 users in Thailand a month).
